Florida law requires the equitable division of marital property and marital debts in a dissolution of marriage action (divorce). Under the concept of equitable distribution, title to the property no longer matters. Marital property means that everything you acquire during the marriage, other than gifts or inheritance, is marital property. Likewise, debts or liabilities acquired during the marriage by either spouse are considered marital debts. The starting point, for the court, is that marital assets and marital debts are split equally. There are some limited exceptions whereby the court can make an unequal distribution. Assets brought into the marriage are non-marital and can usually be kept as separate property upon divorce.
